This Approved Instrument was used extensively by most police services in Ontario until about 2012.

The Intoxilyzer 5000C is still an "approved instrument" in Canada but is now rarely used in Ontario. You can learn more about this instrument by visiting www.impaired-driving.com.

This instrument includes a mouth alcohol detection algorithm to flag "INVALID SAMPLE" when mouth alcohol is detected. This system works with some physiological presentations of mouth alcohol but not all. Individuals with a true BAC of 50 mg/100mls could blow in excess of 150 mg/100mls without triggering the mouth alcohol detection system.

Some Intoxilyzer® 5000 64 Series (the 5000C), 66 Series, and EN series instruments may be affected by radio frequency interference (RFI) from cell phones, police radios, and other electronic equipment in and around the breath room. Sometimes in such cases the instrument may flag "RFI- Inhibit". The difficulty is that sometimes the RFI detection system is not adequate to catch RFI interference. The RFI flag does not work with all RFI environmental conditions. 

It should be noted that not all RFI will affect Intoxilyzer® 5000 results. Some RFI will, depending upon frequency of the transmission, antenna position, strength of signal, and proximity of the device. Unfortunately, serious scientific study of the phenomenon is lacking. Since RFI does affect some functions of evidentiary breath testing instruments, their reliability cannot be assumed if police officers are not maintaining a radio-free and cell-phone free zone in and around the breath room. Serious additional study is warranted. Governments and manufacturers need to be more transparent about the issue and permit access by defence experts to new representative instruments for independent study.
